A plain-English summary of DealerAutoPilot's Terms of Service and Privacy Policy. Know what you can promise, what dealers are responsible for, and what to never say on a call.

🔐 How data is stored
Enterprise-Grade Encryption
All data encrypted at rest with AES-256-GCM. All data encrypted in transit via HTTPS/TLS. Database not publicly accessible — only application servers can connect.

DealerAutoPilot does not sell personal data to data brokers, advertisers, or any third party for commercial use. Data is shared only with: OpenAI (for AI processing), Twilio (calls/SMS), Vapi (voice infrastructure), Stripe (payments), and Render/Neon (hosting). No cross-dealership profiling without consent.

Eve Discloses She's an AI at the Start of Every Call
At the beginning of every AI call, Eve identifies herself as an AI assistant. This satisfies Florida's two-party consent law and FTC disclosure requirements. You don't need to do anything — it's built into the platform.

Dealers Must Notify Customers That Calls May Be Recorded
"All calls, chats, texts, and emails processed through DealerAutoPilot are recorded, transcribed, and stored." Dealers are responsible for notifying customers that communications may be recorded and an AI may be used. This must be disclosed in the dealer's own marketing, website, and signage.

What Eve Can't Guarantee
Per the Terms of Service, Eve's responses may contain errors. Payment estimates are non-binding (not credit offers). Inventory availability is not guaranteed until confirmed by dealership staff. AI-generated information may be inaccurate, incomplete, or outdated.

TCPA Violations Can Cost $1,500 Per Message
The Telephone Consumer Protection Act (TCPA) regulates automated calls and texts. Violations are the dealer's responsibility, not DealerAutoPilot's. Fines are per-message and can add up fast. Follow these rules on every outbound campaign.

Send Automated Texts Without Written Consent
TCPA requires prior express written consent before sending automated marketing texts or calls. Verbal consent is not enough. Get it in writing, keep records.

Call or Text Outside 8 AM – 9 PM
Automated outreach is only permitted between 8:00 AM and 9:00 PM in the recipient's local time zone. Calls outside this window violate federal law regardless of customer consent.

Include Opt-Out Instructions in Every SMS
Every automated text must include opt-out instructions (e.g., "Reply STOP to unsubscribe"). DealerAutoPilot handles this automatically for Eve-initiated messages.

Honor Do-Not-Call Requests Within 10 Days
When a customer asks to stop receiving calls or texts, honor it within 10 business days. Add them to your internal do-not-call list. DealerAutoPilot's opt-out system handles this for Eve-managed contacts.

Florida Dealers: Additional State Rules Apply
Florida has additional state-level consent requirements on top of federal TCPA rules. DealerAutoPilot's platform is designed with Florida compliance in mind, but dealers in Florida should review state telemarketing statutes separately. Contact compliance@dealerautopilot.com if you have questions.

FTC Violations: Up to $50,120 Per Violation
The FTC's March 2026 rule requires all advertised prices to include mandatory fees — documentation fees, registration, dealer add-ons. "Drip pricing" (revealing fees later in the process) is prohibited.

Eve's platform automatically incorporates fees from the dealer's configured fee schedule into every price quote. No drip pricing — full price is disclosed upfront.

Dealers are solely responsible for accurately configuring and updating fee schedules in Master Control. If fees are wrong in the system, Eve will quote wrong prices — and that's the dealer's FTC liability, not ours.

📅 Contract Terms
Month-to-Month, 30-Day Cancel Notice
Either party can cancel with 30 days written notice. No long-term contract required. Setup fees are non-refundable. Monthly fees are non-refundable for the current billing period.
💳 Late Payments
$50 Late Fee + Suspension Risk
Invoices unpaid 30+ days: $50 late fee per occurrence. Access suspended if account is past due more than 15 days after the late fee is assessed. Monthly billing, auto-charge.
🏢 Multi-Location
One Subscription Per Physical Location
Each dealership location needs its own subscription. Sharing one account across multiple locations without separate subscriptions is prohibited and grounds for termination.
🏛️ Disputes
Florida Law, Miami-Dade Arbitration
All disputes governed by Florida law, arbitrated in Miami-Dade County. 30-day informal negotiation required before arbitration. No class action lawsuits (waived in ToS).
